Q:  On average, what is the cost of an NDS e-brief for an appeal?

A: Our current pricing for preparing an e-brief for the California Court of Appeal
averages  $5,000 to $6,000 (3 briefs and an 8,000 page record).  Our pricing, the quality
of our product and our long-term client relationships are the result of 12 years of
continious advances in automation and a commitment to service.

Q:  Are the costs associated with e-briefing recoverable?

A:  Yes, they can be.  We have posted one such order on our Resources page:

Q:  How are costs usually split between the parties?

A:  By far, the most common split is 50-50.  Now and then, parties will
elect to split the cost of preparing the digital record, while each covers
the per-page cost of their own brief(s).  We invoice participating parties
separately.

Q:  If the other party doesn’t participate in e-briefing, won't they get the same benefits
without paying their share?

A:  No - they don’t get a copy of the e-brief until it is submitted to the Court after the last
brief is filed.  They therefore don’t have the same organized and searchable record or
hyperlinked prior brief(s) to use during briefing.

Q:  What additional tasks should I be prepared for if we decide to e-brief?

A:   One of the participating parties will need to ship the record to us (RT, CT, AA, etc.) for
scanning, which we complete and turn around quickly.  The briefs can be sent via email. 
Any of the documents available in PDF can be sent to us via our file sharing site.

Additionally, most of our clients perform cite (link) checking on the pre-final e-brief we
send at the completion of briefing.  We provide an Acrobat™ plug-in that simplifies link
checking.

Q:  Are you able to set a fixed price for e-brief services in advance of briefing?

A:  Pretty much - we base our charges on the number of pages in the briefs (tables and
certificates are not included) and the number of pages in the record.  There are no other
charges.   Counsel usually has a pretty good idea of those numbers and we are
therefore able to closely estimate the final cost.  (Request pricing here)
